Man loses his Appeal against death by dangerous driving

Konrad Budniak, 24, of Walburgh Street, Tower Hamlets, east London, was convicted last August of causing the death of Lindsay Marshall by dangerous driving. Budniak, a decorator, killed a 41-year-old Bulford woman when he drove too fast with bald tyres in wet weather. He has failed in his attempt to challenge his conviction.

Budniak had been driving at more than 70mph along the A303 in wet weather and with bald tyres when he lost control of his Ford Focus and smashed into Mrs Marshall's Renault Clio in August 2007.

He was jailed for three-and-a-half years at Winchester Crown Court, but launched an appeal against his conviction at London's Criminal Appeal Court. But, after considering arguments on the case, three senior judges ruled that it was not "arguable" that the jury's verdict was unsafe and upheld the conviction.
